A Message from the CEO
AAA is a Strong Proponent of Motor Vehicle Legislation
Deborah Barga, CEO, AAA Shelby County
The State of Ohio has made a milestone in combating drunk driving with the enactment of H.B. 388. Known as Annie’s Law, the bill is named after Annie Rooney, who passed away in 2013 after a car crash involving a drunk driver.
Individuals convicted of a first-time drunken driving offense now have the opportunity to petition the court for
The lame-duck session encompassed another bill that makes alterations to rules of the road. H.B. 154 aims to protect cyclists on Ohio’s roadways. With the passage and enactment of this legislation, a vehicle passing a bicyclist must maintain a three-foot distance.
In addition, H.B. 154 allows drivers to proceed through
a red light, provided the driver can prove the light is malfunctioning. Examples of malfunctions would be if the red light lasts an excessive amount of time, or if the light
is not lit. Before entering the intersection, the driver must ensure there is no oncoming traffic. Introduction of the bill was spurred by motorists who found difficulty in having their vehicle activate the weight sensors at traffic lights, especially motorcyclists. Should you ever find yourself in a situation in which you need to take advantage of this law, please know you bear the responsibility of proving the light was indeed malfunctioning.
unlimited driving privileges in exchange for having an interlock breathalyzer placed in their car. The interlock device prevents a driver from operating the vehicle until the breathalyzer is utilized. Furthermore, any jail term the convicted driver faces will be suspended and the court may cut the driving suspension by up to half. If at any time the breathalyzer detects a BCI over the legal limit, the driver will face an extension to the length of time the interlock device will be implemented and will further lengthen the suspension term.
AAA supports legislation that enhances the safety of Ohio’s roadways and became engaged in the proponent testimony during hearings on H.B. 388. Representatives
of AAA stated during their testimony, “Interlocks not only separate drinking from driving, but also help offenders stay legitimately mobile to go to work, school or shopping, and have the ability to take care of their families, all while getting the help they might need with substance abuse
or risky driving.” As a safety advocacy
organization, we are committed to
fighting for the safety of our members.
We will continue to work with the General
Assembly to support proposed bills that
stand to protect Ohioans, and those who
travel through our state.
Annie’s Law goes into effect on April 4, 2017. Washington, D.C. and 28 other states already have similar laws in effect.
As a member of AAA, you can be assured of our commitment to provide thorough research used to establish our lobbyist efforts with state legislators. Our research is obtained through the AAA Foundation for Traffic Safety. Their mission is to identify traffic safety problems, foster research that seeks solutions, and disseminate information and education materials.
